Inheritance certificate

An inheritance certificate (APD) is an alternative to a court decision confirming inheritance acquisition and has the same legal force. It can be prepared by a notary when there is no special testament (e.g., oral, military, drawn up in the face of imminent death) and when all interested parties are personally present (it cannot be prepared through a proxy). After preparing the inheritance certificate, the notary registers it in the Inheritance Register, which gives it full legal force.

Required documents and information

  • abbreviated copy of the deceased person's death certificate - Any Civil Registry Office
  • abbreviated copies of civil status records of interested persons (abbreviated copies of birth certificates, and in the case of persons who changed their surname as a result of marriage - abbreviated copies of marriage certificates) Any Civil Registry Office
  • PESEL number of the deceased along with information regarding the last place of residence of the deceased (ID with a cut corner)
  • Will, if it was drawn up

In most cases, you can obtain documents for the notarial deed by submitting an application online.
