Sale agreement for cooperative ownership right to premises

A sale agreement for cooperative ownership right transfers the cooperative ownership right to residential or commercial premises in a housing cooperative building.

Documents required for sale transactions

Regardless of the subject of sale, the following is required:

  • valid identity document
  • unrestricted PESEL number (Polish personal identification number)
  • in case the current owner acquired the premises by donation after January 1, 2007, or by inheritance – a certificate from the head of the tax office showing that the acquisition is exempt from inheritance and donation tax, or that the due tax has been paid, or that the tax liability has expired due to limitation - Tax Office generally according to the location of the property,
  • in case of acquiring property using funds from a loan and establishing a mortgage in a notarial deed, the loan agreement and the bank's statement regarding the loan – the lending Bank,
  • if the property is encumbered with a mortgage - a certificate from the Bank on the current loan balance along with the technical account number for debt repayment, or if the loan has been repaid, the Bank's consent to delete the mortgage.

Required documents and information

  • basis for acquisition, i.e., the deed of property acquisition (e.g., allocation, excerpt from a notarial deed such as a sale agreement, donation, valid court decision confirming inheritance acquisition, or registered inheritance certificate, etc.)
  • land and mortgage register number, if established for the premises
  • certificate stating that no one is registered as resident at the premises - City or municipal office, can be obtained in person - at the population registry department (Department of Civil Affairs) or online - using a Trusted Profile, on the gov.pl platform (service: "Obtain a certificate of no residence registration")
  • certificate from the Housing Cooperative which will show, among other things, that the Selling Party has cooperative right to the premises, containing information about the composition of the premises, location, and information about the land and mortgage register number for the building, and furthermore, that the premises in question are free from obligations related to current maintenance fees - Housing Cooperative
