Sale agreement for undeveloped land plot or perpetual usufruct right
A sale agreement for undeveloped land plot or perpetual usufruct right transfers ownership or perpetual usufruct rights to an undeveloped land plot.
Documents required for sale transactions
Regardless of the subject of sale, the following is required:
- valid identity document
- unrestricted PESEL number (Polish personal identification number)
- in case the current owner acquired the premises by donation after January 1, 2007, or by inheritance – a certificate from the head of the tax office showing that the acquisition is exempt from inheritance and donation tax, or that the due tax has been paid, or that the tax liability has expired due to limitation - Tax Office generally according to the location of the property,
- in case of acquiring property using funds from a loan and establishing a mortgage in a notarial deed, the loan agreement and the bank's statement regarding the loan – the lending Bank,
- if the property is encumbered with a mortgage - a certificate from the Bank on the current loan balance along with the technical account number for debt repayment, or if the loan has been repaid, the Bank's consent to delete the mortgage.
Required documents and information
- basis for acquisition, i.e., the deed of property acquisition (e.g., excerpt from a notarial deed such as a sale agreement, donation, agreement establishing separate ownership of premises, valid court decision confirming inheritance acquisition, or registered inheritance certificate, etc.)
- Land and mortgage register number
- excerpt from the local spatial development plan or certificate of its absence - City or municipal office of the area where the property is located, application can also be submitted online
- in case of no plan, final decision on development conditions, if issued - City or municipal office appropriate for the investment area
- excerpt from the land register with a drawing from the cadastral map - County office or City office of the area where the property is located
- certificate showing that the property is not located in a revitalization area or Special Revitalization Zone (except for Wrocław) - City or municipal office, can be obtained: in person at the city or municipal office, by mail to the office address, online, via the ePUAP platform
- certificate that the land plot is not covered by a simplified forest management plan, as referred to in Art. 19 sec. 2 of the Act of September 28, 1991, on forests, nor by a decision referred to in Art. 19 sec. 3 of the cited Act - County office
